A bare perusal of both the aforesaid provisions would show
that except for the 'High Court' and the 'Election Tribunal', provided in
the aforesaid provisions, both Section 90 of the Act and Section 101 of
the Act of 1951 are Para materia. The Hon'ble Apex Court had the
opportunity to deal with a similar situation in the case of Prakash
FAO No.4841 of 2009 (O&M) -5-
Khandre (supra) where there was multi-corner contest and held
that: -
Section 90 in The Punjab State Election Commission Act, 1994 [Entire Act]
Section 101 in The Representation of the People Act, 1951 [Entire Act]
Section 13 in The Prevention of Corruption Act, 1988 [Entire Act]
