Udaipal Singh vs The State Of U.P. on 7 September, 1971
In Udaipal Singh v. State of U.P., (1972) 4 S.C.C. 142 the following facts were found against the accused (1) Motive for the murder (2) Opportunity to murder (3) Conduct of the accused. Similar seem to be the facts of the present case. The applicant had motive and opportunity to murder. Also, his statement that his wife had run away was patently false Thus there is a prima facie case against the applicant. The bail appliation is therefore rejected. The observations made above, however, will not be binding on the Trial Court, and will not prejudice the trial.
