For the aforesaid reasons, learned counsel for the appellant submits that the instant criminal appeal deserves to be allowed and the order dated 27.01.2023 passed by the Court of Special Judge/S.C./S.T. Act, (P.A. Act) Sultanpur in Bail Application No. 61 of 2023: Arif Vs. State of U.P., arising out of Case Crime No. 329/2022, under Sections 366, 376, 420, 504, 506 I.P.C. and Section 3 (2) (v) S.C./S.T. (P.A.) Act, Police Station Motigarpur, District Sultanpur deserves to be set aside and consequently, the accused/appellant deserves to be enlarged on bail during pendency of the trial.
