12. A Division Bench of Allahabad High Court also held in case
titled as State of U.P vs. Bhagat Singh & Ors. 1991 (1) Crimes 653
that when both parties suffered injuries in same incident, it was the duty
of the prosecution to explain injuries on accused persons.

11. It is not in dispute that accused Sohan Lal also suffered
injuries in that incident and was taken to Trauma Centre, AIIMS along

with other injured. MLC of Sohan Lal has been put on file by the
prosecution. No explanation is given as how said accused suffered
injury. Following was held by the Apex Court in a case titled as Rehmat
vs. State of Haryana 1996 (3) Crimes 238 (SC):
"Both these witnesses (PW4 and PW6) have failed
to explain 13 injuries on the appellant out of which,
7 were lacerated wounds. It is not the case of the
prosecution that appellant had sustained injuries
prior to 7th April 1986 (date of incident).
