Ld. Counsel for respondent/ applicant has relied upon the judgement of Allahabad High Court in case no. 1997 JIC 1080 (ALL) titled -6- as Habib Vs. Ist Additional Civil Judge & Ors., wherein Hon'ble High Court has held that Muslim lady is entitled to receive maintenance till the date of divorce or till the date of communication of divorce whichever is later. This judgement is not of much help to the respondent as it would have applied to the case, only if respondent would have been able to prove that he has granted valid divorce to his wife. Since the divorce which he pronounced is not a valid divorce as per Muslim law, he cannot take the benefit of the judgement filed and relied upon by him.
