9.1 In AIR 1954 SC 728 in case of Saghir Ahmad vs. The State
Of U. P. And Ors., in the facts of the said case, the question for
consideration before the Hon'ble Supreme Court was that the
petitioners were persons who were operating motor vehicles
for gain on public highways of the State. The petitioners were
in necessary permit to operate the vehicles under the Motor
Vehicles Act, 1939. The State of U.P by virtue of powers
conferred upon it by the Uttar Pradesh State Road Transport
Act, 1950 stopped some of the petitioners from plying their
vehicles on the public highways and instead commenced
plying vehicles of their own.
