8. Challenging the FAA's order, Appellant is before the Commission with
the instant Second Appeal on the ground of denial of request for information
at Pt. 3, 4 & 7 u/s. 8 (1)(h) of the RTI Act, 2005 with the plea that this
exemption is misapplied because the case (O.M.P. (COMM) No. 178/2020,
Union of India vs. Sterlite Industries (India) Ltd.) is not an investigation or
prosecution, but a civil matter concerning the BALCO Shareholders Agreement.
Section 8(1)(h) cannot be used merely because a matter is pending in court.
