In the ultimate analysis, a
coordinate Bench of this Court observed that the advertisement which was
intended to be issued in the year 2019 has to be postponed owing to the
Covid-19 pandemic and, accordingly, it was decided to consider the case
as a special case and further taking into consideration the fact that the
vacancies are to be filled up every year and the same having not been
followed in that case, the coordinate Bench by referring the judgment of
the Hon'ble Supreme Court in the case of High Court of Delhi vs. Devina
Sharma (Civil Appeal No.216 of 2022, arising out of SLP (C) No.4452 of
2022) concluded that the case of the Petitioner deserves to be considered
sympathetically in the facts and circumstances of the case and,
accordingly, allowed the writ petition by granting opportunity to the
Petitioner as a one-time measure.
