12. Accordingly, the respondent MCD is directed to ensure that with effect from 1.3.2006 the petitioners are paid salary equivalent to the minimum of the grade payable to the regularly appointed teachers, for equivalent posts. As clarified in the judgment dated 21.11.2003 the wages/ salary shall be the total emoluments being paid to the regularly appointed teachers. It has also been held in Piara Singh v. State of Punjab that services of ad hoc or contractual employees cannot be substituted by another set of such employees and in the event of termination, the posts can be only filled by a regularly recruited candidates. The respondents are accordingly directed to ensure that in the event of discontinuation of the petitioners services, no contractual/ or ad hoc teacher is appointed in their place.
