The observation made by the learned Single Judge in Patna High Court CWJC No.4147 of 2014 dt.16-02-2016 4/5 Annexure- 18 did not take into consideration an earlier Division Bench decision reported in 2001 (4) PLJR 285, which is the case of Ahilya Devi v. State of Bihar. In addition to that, this kind of dispute had come before the High Court in a batch of writ applications, which was CWJC No.8032 of 1999 and other analogous cases which travelled to a Division Bench.
