As per the judgment in the case of National Insurance Company Limited Vs. Pranay Sethi and others of Hon'ble Supreme Court, 40% of the salary is added.   Apparently   the   salary   of   the   deceased   which   is   stated   to   be   not taxable. Keeping in view the fact that deceased was 19 years old, therefore the   income   for   the   purpose   of   loss   of   dependency   has   to   be   taken   as Rs.3,603.60 (2,574/­ + 1,029.60) per month. It is pointed out by ld. counsel for petitioner that victim was married, survived by her husband.
