16. Having regard to the principles laid down
in the said Judgment stated supra, Ex.D3 cannot be
considered to hold that, there is a partition amongst
the members of joint family of defendant No.1,
consisting of defendants No.1 to 3, Jyothi and
Gayathri Devi @ Kavitha. However, said document
can be considered for collateral purposes, to show
that, there was a partition amongst the children of
V.Venkataswamy, after his death, on 1-9-1990,
Gayathri Devi (wife of 1st plaintiff) is allotted "T-
schedule Properties" of ExD3 i.e., ground floor and
1st floor of Item No. II of plaint schedule.
