32. Sri.P.C.Sasidharan, learned counsel for
Dr.Rehna Augustine, however, affirms his submissions as
above relying on the judgment of the Hon'ble Supreme
Court in Rekha Chathurvedi v. University of Rajastan
(1993 Suppl. (3) SCC 168) and contends rather
vociferously that in the absence of a fixed date indicated
in the notification inviting applications with reference to
which the requisite qualification is to be judged, it will
have to be reckoned as the last date for making the
applications.

The Hon'ble Supreme Court in
Dr.M.V.Nair (supra) has reaffirmed this principle in
paragraph 9 that it is always the last date for receiving
the application which is relevant unless the notification in
question specifies a different date.

contentions as above. There cannot be any difference of
opinion in the proposition of law as stated by
Sri.P.C.Sasidharan. All the judgments referred to above
speak with one voice that a candidate, responding to a
notification, should have acquired the essential
qualification as on the date of application and not on the
date of selection.
