Supreme Court 442 paragraph 13 (Gangappa Gurupadappa
Gugwad Vs. Rachawwa and others) has held that if the final
decision in any matter at issue between the parties is based by a
Court on its decisions on more than one point, each of which by
itself would be sufficient for the ultimate decision, the decision on
each of these points operates as res-judicata between the parties. In
view of the above discussion and the peculiar facts and
circumstances of this case, this appeal is maintainable before High
Court.
