Shri Sant Sadguru Janardan Swami ... vs State Of Maharashtra And Ors. on 25 September, 2001
7. That said, taking note of the fact
that the polling is scheduled to be conducted
on 27/08/2019, and being guided by the judgment
of the Hon'ble Supreme Court in Shri.Sant
Sadguru v. State of Maharashtra and Others
[2001(8) SCC 509], I do not deem it appropriate
to interdict the processes at this stage,
especially because I am unable to see, at least
prima facie, any particular prejudice having
been caused to the petitioners personally,
because concededly, they had time till
02/08/2019 to object to the preliminary voters
list. However, I am of the view that these
issues require a close scrutiny at the hands of
the Electoral Officer or such other competent
Authority of the Election Commission, who
should then decide whether the scheduled
polling, on 27/08/2019, must be allowed to go
WP(C).No.22242 OF 2019 8
on or whether any further arrangement require
to be done.
