I have given my thoughtful consideration to the pleas put forth on both sides. In view of the submissions and the nature of the offence, I am not inclined to release the convict on Probation of Good Conduct. Moreover, in view of the judgment of Hon'ble Supreme Court of India in Dalbir Singh Vs State of Haryana AIR 2000 Supreme Court 1677(1) the convict is not entitled to the relief of benevolent provisions of Probation of Offenders Act, 1958. In view of the facts and circumstances of the case, I am not inclined to grant the benefit of probation under the Probation of Offenders Act to the convict.
