13. Coming to the second question regarding imposition of penalty, a Full Bench of this Court in the case of Girjesh Kumar Srivastava v. State of U.P., reported in 1998 (1) UPLBEC 437 : (1998 All LJ 1604) has held that the Collector has no power to impose penalty.
