Learned counsel for the petitioner also invited our attention to the order dated 27th January 2017 passed by the Division bench of this Court in Review Petition (Writ Petition) (L) No.66 of 2016 in Writ Petition No.424 of 2014 in case of Brihanmumbai Municipal Corporation Vs. Sushma Suresh Pawar and Ors. and in batch of petitions dismissing the review petition filed by the Municipal Corporation. Learned counsel for the petitioner invited our attention to various paragraphs of the affidavit-in-reply filed by the respondent nos.1 & 2 Corporation notorised on 22nd April 2021 and would submit that all these contentions raised by the respondent nos.1 and 2 opposing these petitions were already dealt with in various orders referred to aforesaid and have been rejected.

Delhi Administration and Ors., 1989 Supp (2) SCC 330 and in particular paragraph 4 and would submit that once the dispute in case of Anuradha Jayant Gangakhedkar (supra) had been decided by this Court and upheld by the Hon'ble Supreme Court, the petitioner being identically placed, the Municipal Corporation could not have been treated differently.

Insofar as the order dated 22nd March, 2018 passed by the Division Bench of this Court in case of Ms.Jaywanti Anant Dhanu (supra) relied upon by the learned senior counsel for the BMC is concerned, a perusal of the said order indicates that this Court admitted the said writ petition after adverting to the judgment of this Court in case of Anuradha Jayant Gangakhedkar (supra) after recording the submissions made by both the parties. The said order passed by this Court admitting the said writ petition and not granting interim relief would not advance the case of the BMC.
