Admittedly, the petitioner was ineligible at the time of
admission to the course. A similar issue has been considered by the Hon'ble
Apex Court in the case of Mahatma Gandhi University & Anr. Vs. Gis Jose
& Ors, 2009 (1) RSJ, 438, wherein the following observations have been
made:-
