In the light of the above discussion and analysis, this Court is of the
clear view that the allegations, even if accepted in totality, do not
constitute offences under Sections 376 or 417 of IPC, nor do they
establish the ingredients of Section 66E of the IT Act, while charges
under Section 66A are legally unsustainable in view of the decision in
Shreya Singhal (supra). The order dated 16.05.2023 framing charge
thus cannot be sustained.
