concerned in respect of
prisoners who have escaped or attempted to escape, such
prisoners, a class by themselves, cannot be trusted for being
released ... reduction from higher to a lower class or grade".
Section 8 of The Punjab Good Conduct Prisoners (Temporary Release) Act,
1962 states that

7. Now the question would arise, as to whether
prisoner is not convicted of the said charges under Section 42 of the Prisons Act
he cannot be labelled as a 'hard core prisoner ... hardcore prisoner'. Clause (iv)
relates to a person detected with a cell phone etc. being termed as a

"Hardcore Prisoner". In reply also the ground for rejection of request ... furlough period vide order dated 18.04.2018 passed by the Judicial Magistrate, 1st
Class, Jhajjar while holding that the petitioner could not surrender in time because
seeks four weeks parole for admission of his minor
daughter in nursery class.
Heard.
It comes out that petitioner has been convicted and sentenced ... perusal of the speaking order dated 21.5.2019 passed by
Superintendent, District Prison, Gurugram shows that the petitioner has not
completed one year of imprisonment after
Prisons Act, 1894 was
registered at Police Station, Sadar Ballabgarh, Faridabad. Therefore, the
petitioner is a hard core prisoner and has not completed five years ... copy of the
judgment dated 1.3.2019, passed by Judicial Magistrate Ist Class, Faridabad
which shows that the petitioner and his co-accused has been acquitted
