transfer the
petitioner from the B class to A class in Respondent No.3 Central Prison
within the time stipulated by this Court.

7. Here is a case where a petition has been received by the
Superintendent of Prison for considering the prisoner as a class
filed an application before the trial Court to provide first
class prison facility as per Rules 226(1) of the Tamil Nadu Prison Rules ... recommendation to the 2nd respondent to treat the petitioner as “A”
class prisoner.
4. The learned counsel for the petitioner would further submit
that
that Rule 804 of the
Tamil Nadu Prison Rules provides for classification of prisoner as a “Special
Class Prisoner” to all those who are accustomed ... Prison Rules reads as follows :-
“804. Classification of under-trial and Remand
Prisoners :- (1) under-trial or remand prisoners shall
be of two classes, namely
treated as B class prisoners and that such treatment is given uniformly in all the prisons where nexalite prisoners are confined. Finally, the second respondent ... from others;
(d) by prisoners convicted under Sections 376 or 377, I.P.C .;
(e) by prisoners of the habitual class; and
(f) by other
class prisoner and directed the petitioner
to approach the competent authority through the Superintendent of
Prisons for classification of 'A' class and directed ... Central Prison-I, Puzhal, Chennai u/s.227 of Tamil Nadu Prisoners
Manual 1983, to treat him as 'A class' Prisoner. Since
herein to give
him all the facilities as a 'Special Class Prisoner' even when he is
undergoing detention under Tamil Nadu ... order, the
petitioner was being given facilities as a 'special class prisoner'.
While so, the Commissioner of Police, Greater Chennai has made
against the Prison Manual Rule. Hence, the
Superintendent of this Prison had given prison
punishment as follows:-
