flats, garages, open spaces and undivided interest in the land in proportion to
the area of the flats and garages with the common rights ... portion of the
new building to be constructed on the said plot of land to any buyer or lessee
before delivering possession of the first
open area adjacent to the flat, the undivided share of 34 sq.yards in the land proportionate undivided share in the common areas and amenities ... ground floor.
Accordingly the opp.parties have
provided to the complainant plot

same, we have decided to dispose of these appeals by way of
common judgment. Hence, this judgment.
2. The background of both these appeals ... that his father i.e. respondent
No.2 is having open plot No.7 in survey No. 537/2-A situated within
the Municipal Corporation
open space'. He submitted that portion of open land which was
handed over to the Municipal Corporation was never the part of open
space ... plot bearing CTS No.14813/104
which widely make it clear that it is different plot and has nothing to
do with the plot
having garden area carved out from the common area of
the plot. The O.Ps erected the wall and thereby flat No.2 is separated ... flat No.2. It was not carved out from the common area
of the plot. Hence, they pleaded that complaint should be dismissed with cost
