that the rest of the car parking space inside the building boundary wall, i.e., within the compound of the building was retained ... including walls and cupboard and window projections and balconies) plus proportionate share of area under passages, staircases, common area walls, lifts, on each floor, space
Delhi) were virtually closed by allowing the
raising of wall/construction over the Chhatta/common passage existing
between the property No. 329 and property ... provision for
doors and windows towards the roof of Chhatta. Provision for doors and
windows with opening towards a wall defies any logic
also allowed to put a sign board on the common wall. But it was expressly provided in the lease that front room, verandah, bath room ... verandah for the limited purpose of keeping a show window of 6x9 feet.
(3) Though the lease was for a period of 11 months with
staircase towards which the disputed window of
the Petitioner opened and also that the wall in which the window opened was
owned jointly, half ... Court, closed the window and altered the
position of the staircase to the first floor by cutting into the common wall. Mr.
Ahuja contended that
area under common spaces i.e. staircase, lifts, common toilets, corridors,
louvers, balconies, varandaha, walls etc. and the recessed space below
window sill etc. Though
therein that the respondent be restrained from closing
the gate and the window at the back of his property on the ground that the
same ... gate and the window failing
which he may be permitted to raise a wall so that his gate and window is
closed. Both these suits
blind wall i.e. the wall which does not have any
door/window opening or the lift structure should be at an adequate distance
from
requisite for grant of Permission/NOC:
(i) Consent from owners using common staircase in that
block is a pre-requisite (50% or more excluding ground ... lift structure preferable on the blind wall i.e. the
wall which does not have any door/ window the existing
structure so that the natural
petitioner's unit and the said areas are separated by common walls.
16. The terrace formed by casting a roof over the ground floor ... inconvenience to the petitioner as the said terrace is immediately outside
the window of the dining room of the petitioner. The photographs produced
indicate that
said flat such as OBD on walls, polish on ceiling, door
shutter, UPVC door & window etc. The petitioners submit that these rich
specifications were ... their request the respondent spent a
sum of `55,976/- on additional common area facilities which were in
addition to the commitment of claim made
