[Appointment on Compassionate Grounds] Rules,
1996 [the Compassionate Appointment Rules] stating
that a deceased employee's sister will not be entitled ... that day Rule 3 of the Compassionate Appointment
Rules did not contemplate appointment on
compassionate ground when both the deceased
employee and the spouse were
entitled to compassionate appointment
provided he/she is duly qualified at the time of appointment
as provided in the Compassionate Appointment Rules. He

7. In the present case, the compassionate
appointment is governed by the Compassionate
Appointment Rules which are framed in exercise of the
rule making
declare Rule 2(1)
(a)(i), Rule 2(1)(b) and Rule 3(2)(i)(c) of the Karnataka
Civil Services (Appointment on Compassionate Grounds ... shall not be eligible
for appointment under these rules.]"
It is the said Rules which declines appointment on
compassionate grounds to a daughter
declare Rule 2(1) (a)(i), Rule
2(1)(b) and Rule 3(2)(i)(c) of the Karnataka Civil Services

compassionate basis by himself, but he has
to follow the process and procedure
prescribed under Civil Services
(Compassionate appointment) Rules. In
terms
appointed only by following Rule 12 of 2002 Rules and no
appointment can take place contrary to Rule 12 of 2002
Rules. Thus, he submits ... Compassionate appointment cannot be claimed as a
matter of right, and the authorities cannot offer
compassionate appointment as a matter of course.
