Nature of the marks, that is, whether the marks are word marks or
label marks or composite marks, i.e. both words and label works ... arbitrary mark for whisky. Therefore, the
respondent has vast reputation and goodwill in the said mark. The appellant
is using a composite word mark „Collector
SUPERLINE' under TM.No.1353683 is for a device and composite mark. During the prosecution of the mark vide hearing dated 14.12.2005, the plaintiff ... label.' Therefore the plaintiff's trade mark is a composite mark which has combination of more than one work. The plaintiff does
composite marks of the
plaintiffs containing the mark LUMAX, duly registered with the Trade
Mark Registration No. 259394 and 426009.

that the Courts whilst
dealing with cases of trademark infringement involving composite marks, must
consider the composite marks in their entirety as an indivisible whole ... mark as a whole and
not by its component parts. The Identification of 'Dominant Mark' would suggest
that while a mark
committee who conducted the interviews did not
give separate marks individually but a single collective marking for each
candidate was done by the committee ... requirement as such.
The Division Bench, with respect to composite marking in the interview,
found that it is for the examining body to decide
