first respondent to
treat the period between 24.07.2012 and 16.04.2013 as
compulsory wait as per Fundamental Rules and to extend all
benefits both service ... compulsorily wait for orders of posting, such period of waiting
shall be treated as duty period and during such period of
compulsory wait, he shall
from 01.07.2007 to 02.01.2008 during which the petitioner was kept
under compulsory wait as duty period. The second respondent is duty
bound to give ... explanation to the Government for keeping the
petitioner under compulsory wait for more than six months. Therefore,
the second respondent has obtained the letter from
regularise the period from 20.09.2007 to 25.09.2007 as period of
'Compulsory Wait' and to fix or revise the pensionary benefits of the

compulsory wait for the non-joining period 22.12.2009
to 28.07.2010 which is in violation ... without joining duty for the
period of 7 months and requesting compulsory wait for
the said period, he has tested the administrative
efficiency
petitioners to treat the
absence period from 21.08.1998 to 17.12.1999 as
compulsory wait; and therefore, prayed this Court to
pass appropriate orders in the writ ... therefore, the Tribunal was justified in
treating absence period as "compulsory wait" and
therefore, there are no merits in this writ petition
During this process, for administrative
reasons few employees/officials were on compulsory wait for
a certain period of time.
7. It is further submitted that ... also due to
certain administrative exigencies, some employees were on
compulsory wait for some period of time. However with the
cadre allocation and consequent posting
reporting to duty
i.e., September, 2005 shall be treated as compulsory wait
and the applicant shall be paid all the pay and allowances
according ... directed to treat the said period as compulsory
wait. Therefore, appropriate orders may be passed by
setting aside the orders passed by the Tribunal
period for posting orders, i.e., from 10.08.2007 to
19.02.2008 as compulsory wait with consequential benefits.
The Tribunal, vide order dated 14.09.2011, allowed the said ... period from 10.08.2007 to
19.2.2008 is liable to be treated as compulsory
