When a person already undergoing a sentence of imprisonment is sentenced
on a subsequent conviction
turned down affirming the sentence also
with the modification of allowing him to undergo the sentences
imposed concurrently ... under Section 461 of the IPC with direction
to undergo the sentences concurrently. No set off was allowed
in this case. His appeal

another offence :- (1) When a person already undergoing
a sentence of imprisonment is sentenced on a
subsequent conviction ... undergoing
sentence then subsequent imprisonment is to commence only on the
expiration of the previous sentence, unless both sentences are ordered to
run concurrently.
Section
Sentence on offender already sentenced for another offence.
(1) When a person already undergoing a sentence of imprisonment is
sentenced on subsequent conviction to imprisonment ... sentence shall run
concurrently with the previous sentence. Such direction to make the
sentences to run concurrently, as per various decisions noted above
order directing the sentences to
run consecutively. These have to so run as there is no direction for
running the sentences concurrently. If the sentences ... remissions of sentences are even
permitted.
Be that as it may, a case for making the sentences to run
concurrently is made out. The appellants
sentence shall run
concurrently with the previous sentence.
(4) Direction to make the sentences to run
concurrently can be exercised by the trial Court ... imprisonment in another case - Subsequent sentence
shall run concurrently - No specific order of
concurrent running of sentence is required -
However, a person who is undergoing
Sentence on offender already sentenced for another
offence .- (1) When a person already undergoing a sentence of
imprisonment is sentenced on a subsequent conviction ... sentenced. Under this rule, sentence of the second case would run after
the appellants had completed the sentence of first case and the sentence
awarded
submitted that while calculating the sentence of imprisonment in default of payment of fine, the sentence cannot run concurrently and relied on Rule ... state that while calculating the sentence of imprisonment, sentence imposed in default of payment of fine, cannot run concurrently.
26. In our considered opinion
imprisonment to which he has been previously sentenced, unless the Court directs that subsequent sentence shall run concurrently with such previous sentence. There is however ... whilst undergoing such sentence, sentenced to imprisonment for an offence committed prior to the making of such order, the latter sentence shall commence immediately
