is alleged that he was showing a constructive indifferent attitude
in each and every day to day life ... compelled to live separate in view
of the aforesaid constructive methods of cruelty, desertion and
absence of provision for maintenance. It is also stated that
that his wife has deserted him since
1.12.1998. Hence, he sought for divorce on the
ground of cruelty and desertion. The respondent

5. With reference to the allegation of
desertion, it is admitted that the building was
constructed near the school of the petitioner
properties and
constructed new buildings without consulting the petitioner.
Finally, petitioner started companies in his own name. He further
