16. It is brought to our knowledge by learned Authorized Representative

building could not be constructed for the reasons which were beyond the
limit and control of opponent

The opposite party met with the complainant and offered to construct
residential house as per the sanctioned plan ... knowledge of
the construction of residential house. The opposite party after inspecting the
site, had assured the complainant to construct a good qualitative house
waiting for
possession of dream house.

constructing flats of 485 sq.ft. built-up area.
Accordingly, construction of building was done. She submitted that
complainant was having knowledge of the same ... gone through
details of the agreement she had no knowledge of the mistake that had taken
place while drafting agreement. However, she submitted that complainant
amendments to the
Development Agreement. Opposite party No.3 was to construct and
complete multi storey group housing complex to be known as
'Gardens ... opposite party No.3 and that fact
was very much in the knowledge of the complainant. In all these
circumstances, the complaint is not maintainable
