4. It is argued by Ld counsel for convict that convict namely
Gulshan Jagga is aged ... probation of good
conduct and behaviour. Hence in the interest of justice, benefit of
Probation is granted to the convict u/sec. 4 of Probation
Suresh Kumar v. Jagdeeshan , (2002) 2 SCC 420, the convict
cannot be released on probation and appropriate sentence is required to be
passed.
