complainant submits that after the death of the
deceased, the cremation was being done in very clandestine
manner.
4. Heard perused the case diary, more
witness-Himanshu that the petitioner was present in the
procession and cremation of the deceased. Thus, the presumption
of innocence in favour of the petitioner
that all the family
members of the complainant were there and the cremation was
about to be performed. The police team was also there
deceased, the body was handed over
to the petitioner for cremation. A baby boy is also living with the
parents of the petitioner
