CSMA Rules.
4. Port trust hospitals.
The availing of medical facilities in aforesaid hospitals is
subjected
applicant's mother in accordance with the CGHS/CSMA Rules, and the
balance amount, as claimed by the applicant in the present ... reimbursable to her under the CGHS/CSMA
Rules. Her grievance was that despite the Emergency Certificate issued by
the Fortis Hospital, the respondent
were governed by CCS (Pension) Rules, 1972 or
other corresponding rules in operation prior to commencement of these rules
and are eligible for medical facilities ... provided.
12 Applicants are covered by CSMA Rules, 1944. Rule 3(i) and 3(ii) of
CSMA Rules reads as follows:
' Rule
attaining the age of
superannuation. They were availing the benefits of CSMA Rules,
1944. After retirement, they sought for granting of CGHS benefits in
place ... CSMA Rules. However, the respondents, vide impugned
Annexure A/1 dated 29.01.2016, rejected the said request by stating
that serving as well as retired teaching
resident of Delhi. However, she
was availing the benefits of CSMA Rules, 1944. After retirement, the
applicant sought for granting of CGHS benefits in place ... CSMA
Rules. However, the respondents, vide impugned Annexure A/1
dated 30.05.2016, rejected the said request by stating that serving as
