4. Admittedly
this writ petition the petitioner has prayed for grant of
DACP. Admittedly the petitioner is in the medical cadre. He retired
on 31.01.2003 as Medical ... Officer, Giridih. The issue of DACP has
already be decided by the Division Bench of this Court in LPA
No. 86 of 2018 titled
direction upon the concerned respondents to make payment
of benefits of DACP as the same has not been paid by the
concerned respondents ... pension of the petitioner on the basis of the benefits of DACP for
which petitioner is legally entitled.
2. So far as grant of DACP
under:-
"20. The advertisements issued by the appellant mentioned
that the DACP scheme would be applicable for its recruits.
However, it is a settled
this writ petition, the petitioner prays to revise,
refix and grant the DACP and consequential benefits thereof.
