through pick up points in hotel establishments in which dance
programmes are being conducted (Dance Bars) and that dance forms
being presented therein are horrid ... consent. It was emphasised that as a general
rule, dancing in a dance bar is not a profession of choice, but of
necessity, and consequently
means any artist performing dance on the stage or in
any part of the premises;
(8) “obscene dance” means a dance that is obscene within ... holding such
dance performances. The Government considers that the
performance of dances in eating houses, permit rooms or
beer bars in an indecent manner
were allegedly caught dancing
in a scantily clad state. "A raid was conducted
on the premises of El Dorado dance bar in Hotel
Rajdoot ... translation reads as
under:-
"13 Bar Girls arrested from Hotel
New Delhi, JS. Thirteen Bar Girls, dancing in
provocative and semi-nude condition, arrested
imposes a complete ban on people choosing dancing in dance bars as an occupation and cannot be construed as a reasonable restriction under Article ... procedural fairness, as it imposes a blanket ban on all dance performances in dance bars without providing a procedure under which their fundamental rights
those decisions while rejecting the
argument of public morals (banning dancing bars) by the state, also ruled that
“dancing in bars could not be held ... obscene dances.”
34. The next decision to examine the same issue, was IHRA-III. The 2016 Act
sought to completely prohibit dancing in bars. This

that the premises may be used for
dance bar/ ladies bar and the presence of dance bars/ladies bar would
cause negative impact ... would operate the dance bar/ ladies bar. In view of the provisions of the
Act 2016, even the operating of dance bar

placed on the following ... parties. Firstly, we do not
find that the said judgment in Dance Bars' case (Supra) has any application in
the present case
