JUDGMENT ... incident of rape.
Even otherwise also, the marriage between a rape victim and the
assailant subsequent to the incident of rape does not merit
test. The application has
been allowed by the order dated 20.6.2014 against
which petitioner approached this Court in
Criminal Revision Petition No.100148/2014 ... alleged by the complainant
that the accused has committed a date rape and
acquaintance rape. He had made promise to
marry the victim
upon me forcibly. I do not remember
the exact date now. Thereafter, accused kept committing rape with me.
After 24 days, accused expelled ... upon her forcibly. She does not
remember the exact date now. Thereafter, accused kept committing rape
with her. After 24 days, accused expelled
patient being given sedatives on 05/08/2009
followed by rape. Last date of intercourse being 21/08/2009 ... date of birth of PW4 prosecutrix (name withheld) was
04/07/1997.
As the date of alleged incident is 05/08/2009 and the date
prosecution case and creates serious doubts in it.
21. The rape incident dated 01.8.2009 seems to be totally
fabricated. According to the prosecution ... show that she was under any
such threat. When the alleged rape incident dated 01.8.2009 has
to be disbelieved, as noted herein above, there
called brother Mithilesh immediately
before and after the alleged incident of rape dated 17.08.2011.
72. As aforesaid, mobile phone No.8527339687 was admittedly
being used ... would reveal that at the time when the
incident of rape dated 17.08.2011 allegedly took place, the Prosecutrix 'P'
was in conversation from

concerned, the prosecutrix has not stuck to one date. She has
mentioned the date differently in her statements

lodged at PS Paharganj and that of her complaint made to DCP, West Distt.
dated 04.07.2011 as Mark ... lengthy cross
examination with regard to the alleged incident of rape dated 29.11.2010.
The Prosecutrix, though admitted, that she herself met the accused at hotel
that after kidnapping on
24.04.2012, accused Manoj raped her for two days. In her
cross examination dated 06.05.2013 in this court, she
stated that only ... dated 06.05.2013, she stated that
only accused Manoj committed rape on her. In her
complaint dated 28.4.2012 (Ex.PW1/D6) which
