utter a single word, regarding the incident of rape dated
22.04.2013 allegedly committed by the same accused, either to her parents
or to the police ... commission of alleged rape as the opinion was taken after seven days of the
alleged rape. The victim, in her complaint dated 27.04.2013, stated that

as and when the accused subjected her to rape. The incident of
rape was revealed by her to her mother Narbada Devi ... silent about the alleged incident of rape dated
15.3.2008.
18. Interestingly enough, when PW-1 Jiwa Nand was
cross-examined, he was present
Considering the consistent recurrence of
the heinous crime of rape and gang rape all
over the country including the metropolitan
cities ... which he
learnt about the commission of the offence of
rape and the date and time at which he took
the victim to the Metropolitan
statement clearly stated that on the date of
incident appellant did not commit rape with her and some quarrel
occurred with the appellant ... date of incident,
but when Government pleader asked leading question to her.She
clearly deposed that on the date of incident appellant committed
rape with
years of age, class 9th student,
on the date of occurrence has been raped by the
accused "a tutor" at his own residence ... telephone to Mushtaq Sir.
She has no knowledge till date as what is called
"rape" as she has not seen the rape
stood on the
date of occurrence submitted that it is clear that where a woman is raped
by one or more in a group ... affirmative. On that date at about 3.00 P.M.,
she heard that the victim had been murdered after being raped by some
persons. She denied
failure to keep a promise
made with respect to a future uncertain date, due to reasons that
are not very clear from the evidence available ... promise to marry her is a consent which excludes the offence of rape?

14. Statement of the accused ... incident, has proved this fact that occurrence of rape was committed by the appellant on the date of incident i,.e. on 05.10.2009, at about

morning and raped on the same day in the evening when

did not state about any incident of rape/attempt to rape in the morning
of 11th December, 2012 or four months prior
commission of such heinous crime of rape. Even defence cannot
bring on record that on the date of incident i.e. on 14/5/1998 ... injuries on the
body of victim, indicate that, she was raped on the relevant date
and time as deposed by the victim
