Trial of the suit has taken place. Trial Court
had appointed DDLR as Commissioner to conduct local
inspection. A report having been submitted, finding that ... order dated 23.2.2013 directing the re-issuance of
commission warrant to DDLR. Assailing the said order,
defendant No.14 has filed this writ petition

Both the parties submit that the matter is pending before the
DDLR and in the meanwhile, the order of status-quo may be
granted ... main matter itself is pending before the
DDLR, the DDLR is directed to dispose of the matter
continuing the status-quo order as on today
challenged the
order of ADLR in appeal before the DDLR. But the order of
the ADLR had been confirmed. The said orders of the
ADLR ... DDLR have also been confirmed by the
Karnataka Appellate Tribunal in Rev.No.139/1992 on
18.1.1992. The plaintiffs also pleaded that the sale deeds
also not in dispute that all the parties approached the
DDLR and requested him to cancel the previous phodi effected
dividing Sy.No.51 into ... their
request, the DDLR had cancelled the earlier phodi effected.
Therefore, when the Court Commissioner visited the spot, he
found that the earlier phodi effected
measuring 2 acres.
Subsequently, the order was modified directing the
DDLR to be appointed as Court Commissioner. The
