Respondent No.5, with whom the deceased was working as a driver. The
deceased was proceeding in the tractor from Nigdi towards village
Tawade, Taluka ... dash to the tractor.
The tractor was upturned and the driver i.e., the deceased, died due to the
injuries SO his dependents
that on the date of accident he had engaged the
deceased as his driver but he contended that he was not
permanent employee ... appearing for respondent No.1 did not dispute that the
deceased was working as driver with respondent No.1
though the aforesaid stand is taken
legal heirs of deceased, they
have specifically contended that the deceased was in service of

It is contended that when the deceased was boarding the
vehicle, the driver of vehicle ... turn, when the vehicle was slowed down by the driver,
deceased tried to board the vehicle from back side but he fell
on the road
driver of the said tractor as his witness.
In his evidence before the tribunal said driver viz; Dilip Laxman
Chandane has deposed that deceased Ayyub ... that, the informant and the
driver of the tractor had stated in their respective statements that
deceased was sitting in the trolley, however, the said
