restrained permanently from using the mark FEMICONTIN or any
other mark deceptively similar to FECONTIN-F or the CONTIN
"family of marks ... product as well as specifically against any trade
mark which was deceptively similar to the registered trade mark
FECONTIN-F.
(v) In July
wrongly granted and is prima facie invalid being a
mark deceptively similar to the Plaintiffs trade mark
ABROS. The publication of the Defendant ... Section 11(3)(a) : The adoption of

otherwise, between the marks OPAL and SHEOPAL'S. As such
GULSHAN-E-KARIM
or any other mark which was confusingly or deceptively similar to the
registered trade mark of the respondent.

deceptively similar to the registered trade marks of the respondent, the

constituted a prominent feature, as the mark
would, thereby, become deceptively similar to the appellants
registered trademarks.

deceptively similar. This has necessarily to be ascertained by a
comparison of the two marks
