12. This injunction is continuing
namely,
misrepresentation, damage to Plaintiffs reputation
by use of identical/deceptively similar mark are
satisfied in the present case and it is clear that
Defendant
Green and
Yellow colour combinationI and a product
packaging identical or deceptively similar to the
Plaintiff's products under the brand name/ mark ... Yellow colour combination and a product packaging
which is identical or deceptively similar to the
Plaintiffs'
products under the brand name/mark 'TORQ
dealing with the impugned
mehandi and henna products under identical or deceptively similar packaging
of the Plaintiff's products having green and white colour
written in a logo form, writing style and trade dress
similar to that of the Plaintiffs.
17. The Plaintiffs are also aggrieved by the promotion ... After having seen the Defendants' use of the identical and deceptively
similar mark 'BOLTTBUS' and 'BULLETBUS', as also the initial
RAJMOTI BRAND or any other Trademark/Label
identical with or deceptively similar to the Plaintiffs
aforesaid Trademark/Trade Name consisting of the
word RAJMOTI ... bearing the
impugned and violative Trademark/Trade Name or any
other deceptively similar Trademark/label including its
blocks, labels, display boards, sign boards, trade
domain name,
email addresses, website address; and/or any
other mark deceptively similar to the Plaintiffs
trade mark/name INTEL and/or in any manner ... mail addresses,
web-site address and/or any other mark deceptively
similar to the Plaintiffs trademark INTEL and/or in
any manner whatsoever doing
