opinion that the object of granting the injunction would
be defeated by delay, and require the applicant--
(a) to deliver to the opposite party ... reasons for its opinion that the object of granting injunction
would be defeated by delay. Therefore, the crux of the issue is that
the Court
opinion that the object of granting the injunction would be defeated by delay, and require the applicant-
(a) to deliver to the opposite party ... opinion that the object of granting the Injunction would be defeated by delay. The Court shall require the applicant to act terms of Clauses
opponent before granting injunction
unless it appears to the Court that object of granting
injunction would be defeated by delay. It was urged that
while ... such an injunction, without issuing
notice, to record reasons for its opinion that the object
of granting injunction would be defeated by delay
injunction
without recording reasons to demonstrate
12
that object of granting of ex-parte order of
ad-interim injunction could be defeated by
delay ... injunction had to be
30
granted by dispensing notice to the respondents
or that non-grant of an injunction would be
defeated by delay
specifically that the object of grant of injunction would be defeated by delay if injunction is not granted and it is sufficient for the court ... granting ad interim injunction, the court ought to have stated that the object of granting injunction would be defeated by delay and in the absence
opinion that the object of granting
the injunction would be defeated by delay. Referring to the
impugned order, it was submitted that in the entire ... opposite party
before granting an injunction except where the object of
granting injunction would be defeated by the delay. In terms of
the proviso thereto
opinion, that the object of granting the
injunction would be defeated by delay, the Court should
record reasons for its opinion as required by proviso ... opinion that the object of granting the injunction would be
defeated by delay......
It has come to our notice that in spite of the aforesaid
opinion that the object or granting the injunction would be defeated by delay, and require the applicant-
(a) to deliver to the opposite party ... appears to the Court that the object of granting injunction would be defeated by delay, the Court shall, before granting an injunction, direct notice
before the injunction is granted. But in exceptional cases "where the object of granting the injunction would be defeated by the delay ... grant an ex parte injunction is whether "the object of granting, the injunction would be defeated by the delay." In the present case
satisfaction of the court that the object of granting injunction would be defeated by the delay if notice was given.
