towards write back of stale demand drafts as an income
for assessment year 2007-08 and the aforesaid amount
was allowed as deduction in computation ... amount accrued to
the assessee on account of demand drafts and gift
cheques, which have lost its validity. It is further held
that since
Transport
Commissioner in which he has stated that the demand draft has been lost by
mistake. Now the petitioner is ready to pay amount ... give the interest/penalty alongwith demand draft of Rs. 1 lac to the State
Government.

demand draft in question to the plaintiff
is merely a fabrication and a ruse put to avoid their liability. It is
averred that demand draft ... been issued by the defendant bank that 50 demand
draft forms having been lost and missing from their branch. It
is averred that the defendant
between the parties. However, upon presentation,
the Demand Draft was returned back with the report "lost".
3. Arguments heard. Record perused
with following further conditions:
(i) the appellant shall prepare a demand draft of an
amount of Rs.20,000/- (Rs.Twenty Thousand only ... receipt.
