absorption of employees who were on
deputation. Since the petitioner is also on deputation,
he has the right to opt for absorption, by repatriating ... been deputed to the
Department of Water Resources by order of
deputation dated 01.07.2021 vide Annexure-B with a
condition that the deputation
petitioner has no right as
such for deputation, once he is deputed he has a right
to continue in service at the post where ... legal right to continue in the post. A
deputationist indisputably ahs no right to be
absorbed in the post to which he is deputed.
However
create any
semblance of right contrary to the general rule that a
deputationist has no legal right to continue on
deputation, or a right ... have been on deputation for eight and
five years. The contention that they must be continued
on deputation only because their deputation is extended
order of
deputation would specifically indicate that deputation of
deputationist was "until further orders", in other words,
deputation was not for any fixed ... period of deputation. The above said
Rule clearly indicates that a person who was transferred or
posted on deputation, cannot claim any right to hold
well-settled
that the employee who has been sent on
deputation, has no right to claim absorption.
But in the case in hand ... that an
employee who has been sent on deputation has no right to
claim absorption irrespective of the amount of years that
he has worked
have no responsibility in such matters. However, the
appellant have the right to depute its representative(s) to
inspect the premises during working hours ... note of Clause No.5 that the appellant will have the

outside the cadre or outside the parent department.
Deputation is deputing or transferring ... There
can be no deputation without the consent of the
person so deputed and he would, therefore, know
his rights and privileges in the deputation

15. The individuals deputed from their parent
cadre or department do not inherently possess legal
entitlements to the deputed position. Instead,
deputation serves ... before deputing petitioner
violates established procedures and protocols.
Deputing an employee who has previously completed
a deputation without proper justification is amenable
for judicial review
