petitioner is of 9700 intoxicant tablets and as per FSL report,
Diphenoxylate Hydrochloride per tablet is 2.36 mg and Atrophine Sulphate
per tablet ... carboxylic acid ethyl ester (the
international non-proprietary name of which is
Diphenoxylate), and its salts, preparations, admixtures,
extracts and other substances containing
accused Bir Chand, has
opined, qua, each tablet carrying, only, 2.52 mg
Diphenoxylate hydrochloride and 0.025mg Atropine
Sulphate , (ii) yet the aggregate weight ... exclusive possession of
the accused, without segregating therefrom, the pure
contents, of, Diphenoxylate hydrochloride, and,
Atropine Sulphate, renders, the apposite haul, to fall,
within
Lomotil, Alprawin
0.5 and Alprawin 0.25 contained prohibited drugs namely
Codeine Phosphate, Diphenoxylate Hydrochloride and
.
Alprazolam, respectively, whereas, other drugs were not found ... cough syrups namely Altorex and Onerex, respectively. 2.47 mg
Diphenoxylate Hydrochloride and 0.0254 mg Atropine Sulphate
in 3 strips of tablets namely Lomotil was found
drugs namely
Corex and Lomotil contained prohibited drugs namely Codeine
Phosphate and Diphenoxylate Hydrochloride. Report of FSL further
revealed that 1.981 Mg Codeine Phosphate ... found in one hundred ml.
bottle of Corex Syrup whereas 2.517 Mg Diphenoxylate Hydrochloride
was found in tablet of Lomotil. Since capsule Spasmo Proxyvon Plus
shown to be recovered from the appellant was stated to
be 'Diphenoxylate', though in the FIR it was stated to be 'Amphetamine ... appellant is shown to be Diphenoxylate.
He next submitted that the patrolling party was stated to be in a
private vehicle, with no copy
with some objections of rectification. On
analysis, the powder was found containing diphenoxylate vide
report dated 03.08.2013. Vide report dated 27.11.2013, the
average weight ... salt therein dextropropoxyphene and 220
grams of intoxicant powder containing salt therein diphenoxylate
without any valid permit or licence, thereby committing an offence
under Section
quantum thereof, yet, the purified content, of, the aforesaid
LOMOTIL i.e Diphenoxylate as found, in the exhibit, carrying
a weight, of, 15.15 grams, hence ... Nitrazepam and

Diphenoxylate,occurring at serial No.221 and 44 of, the table
appended, with
substance which, subsequently, upon analysis has
been found to be containing 'Diphenoxylate hydrochloride'.

quantity being commercial quantity, the interim bail
found in conscious possession of
7400 tablets of lomotil containing Diphenoxylate. Against the aforesaid
