undertaking that they would return the documents if they were traced and
that the documents were lost at their end
and mulct liability in case ... certificate that these documents were
given by it in lieu of original documents specifically mentioning that they
were lost at their end.
9) The
complainants
complainant required original documents only at the time of oral interview. The
original documents are not required for written examination. Only successful
candidates ... opposite party coupled with the cost of the original documents
lost in the transit. However, the
complainant failed to submit the mode/method in arriving
wrong address and not to any person but had lost the document and inspite of that the OP stated that they could not
do anything ... Admittedly, the complainant did not receive
the policy document. The policy document
was lost by Blue Dart Courier Service, to whom it was entrusted
when the OP lost the documents only the documents relating to receipt of the
shares from the petitioner were lost and not the other documents ... does not benefit the
Company. It is further contended that
the documents were lost at a stage when petitioner was acting with negligence
in getting
request for return of the documents was kept pending by the appellant bank on
the premise of the documents being misplaced while its office ... such a long time which goes to draw inference that the document is lost while
it was in the custody of the
appellant. On account
documents
remained in one brief. In case the affidavits are with the appellant
then how the other documents were lost. In these circumstances, the
story
return of documents, but
nothing was done. It was stated that despite the fact that the original
documents were with the OPs, and the complainant ... return his original documents. In response, he received a letter dated
27.11.2008, from the OPs, stating that the documents were lost. It was further stated
baggage is Ext.P8 and P8(a) documents. Ext.P8 is a document issued from Talal Super Market, Shaik Colony Shopping Complex ... baggage. The only document which can be relied on is P8 document produced from the side of the complainant. That document would show that
secondary evidence are
that such original documents could not be produced by the
party relied upon such documents in spite of best efforts,
unable ... production of primary evidence. Unless, it is
established that the original documents is lost or destroyed or is
being deliberately withheld by the party
seized by stating that it fell under category of 'Lost travel document', as a result whereof, the complainants could not board their scheduled ... Drill status showing Passport "LOST". Complainant no.1 was not even shown any copy of the alleged document showing such status
