cheque to the bank, (3) Returning the
cheque unpaid by the drawee bank, (4) Giving notice in writing to the
drawer of the cheque demanding ... with Sections 3 and 72 of the NI Act was the drawee bank
or the collecting bank and this Court held that
drawee bank (Bank of the respondent/accused)
in New Delhi by the petitioner/complainant
through its Bank (collecting bank) at New Delhi?;
II) Whether ... bank. The branch
acts only as a facilitation centre. Cheque is always drawn on
the bank, whether, payee bank or the drawee bank.
29. Section
bank", ...... "by an

forwarded by a collecting Bank to a paying Bank, and the paying Bank makes payment to the collecting Bank, who in turn passes ... between the payer Bank and the collecting Bank. That is the precise question involved in this case.
(21) The collecting bank, viz., defendant
branches of the bank are covered under Core Banking
Solutions (CBS) and in terms of guidelines issued by Reserve Bank of
India vide circular ... home branch of the drawee bank where the accused was
having the bank account in the said bank. In other words, the main

cheques were presented to the drawee bank being Bank of Punjab Ltd.,
New Delhi for encashment. Two other cheques ... cheque at Digras
