opinion, death was due to asphyxia as a result of ante mortem drowning and the
approximate time since death was 24 to 48 hours.
However ... stated that he cannot say whether the drowning was suicidal, accidental or
homicidal in nature.
12. P.W. 7 was the Addl
boat
carrying 38 passengers overturned resulting in death of 22 passengers by drowning. Sursagar
Lake was under control and management of the Vadodara Municipal Corporation
suddenly, he slipped and fell into the water and died due to drowning. By referring
to paragraph-5 of the judgment rendered in Mackinnon Mackenzie
Haque, aged about 3
years, was asphyxia as a result of antemortem drowning and there was no eye
witness.
The F.I.R. reveals
deceased was due to
asphyxia as a result of antemortem drowning.
The case diary reveals that there was no eye witness to the alleged
occurrence
morning and reported that his wife had died due to
drowning in a pond.
PW10 also stated that during interrogation, the appellant confessed
his guilt
reveals that the cause of death of
the deceased was asphyxia following drowning.
Having considered the submissions made by the learned counsel of both sides
Bangladesh border, one police Constable namely, Raben Das was drowned to death in the
river 'Dead River', by cattle smugglers while ... cause of death of the deceased was asphyxia
as a result of drowning.
A perusal of the case diary reveals that two cattle smugglers including
cause of death of the deceased Nurul Sikdar was
ante mortem drowning. There is no prima facie direct evidence against
the petitioner requiring his custodial
deceased persons was
due to asphyxia as a result of ante-mortem drowning.
