23. In this case, the victim ... sine qua non of the offence of rape is penetration and not
ejaculation and therefore, this contention is also rejected.
25. Now, turning
force. P.W.2 has not at all stated that there was ejaculation of semen during the sexual intercourse performed by the accused ... vaginal smear taken from P.W.2. Assuming that there was ejaculation, since P.W.2 was examined after about 5 days, due to passing
enough to constitute the offence of rape and sexual
assault, for which ejaculation is not a sine qua non. Considering the above
