They were at the most
unauthorized sub tenant liable to be ejected in execution
proceeding.
In the light of above discussion, all the
objections/petitions
suit, the object of the landlord is to eject the
sub-lessee from the land in execution of the decree and such an object
suit for ejectment filed by the plaintiff, till
he succeeded in perfecting his title in the suit for specific
performance, after the execution
Suit no. 76/1980 was decreed on
10.11.1980 for rent and ejectment against the plaintiff's father. The plaintiff as Legal
representative ... which were dismissed. The suit property was delivered to the
defendant during execution proceedings of the aforesaid decree on 23.05.1983. It
was averred that
tenant who was not let into possession by the
person seeking to eject him is not estopped from denying the
plaintiff's title ... title is in some third
person or in himself. But the execution of a lease or payment of
rent by the defendant is a prima
ejectment against said heirs who was in
occupation of premises - decree cannot be challenged by other
legal heirs at the time of execution
review application as well as revision

was filed, same Counsel who has now filed the present
appeal, filed ... that the entire property
was purchased by the petitioner and therefore, rightly
ejectment was sought. It was further submitted that instead
of helping the appellant
submitted that suit of the plaintiff for recovery of
possession/ejectment/mesne profit, damages for
unauthorized use and occupation and also for permanent
injunction ... since the
appellant has failed to deposit the said amount, so, in
execution of the judgment and decree, the respondent No.
1 has taken
JUDGMENT
1. By this Judgment, I shall decide a suit for ejection,
recovery of arrears & mesne profits filed by the plaintiff against the
defendant ... rented premises.
2. It is further alleged that at the time of execution of Rent
Deed, the defendant handed over three post dates cheques

power of attorney in his favour by Sh. Samuel Gokul Chand cannot
